The purpose of these General Terms and Conditions of Sale is to regulate the remote online purchase of cosmetic products from ardescosmetici.it.
The owner of the Website is Ardes srl with registered office in Via Fontanelle, 18 – 16012 Busalla (Genoa) Italy – VAT No. and Tax Identification No. 02776490100 – CCIAA 294949 – Genoa Trade Registry No. 45679.
All purchases of products made through the website by users accessing it (hereinafter, the CUSTOMERS) are governed by these General Terms and Conditions of Sale.
Ardes may amend the contents of the General Terms and Conditions of Sale at any time and without prior notice.
The placing of an order by the CUSTOMER implies acceptance by the latter of the terms and conditions of sale in the version published on the website at the time the order is placed.
All CUSTOMERS are advised to read the General Terms and Conditions of Sale carefully before making a purchase.
Object of the contract
Ardes srl sells and CUSTOMERS remotely purchase the products offered for sale through the website ardescosmetici.it.
The contract is concluded exclusively via the Internet, by means of CUSTOMERS accessing the website and placing a purchase order in accordance with the procedure set out therein.
The website can be accessed from anywhere in the world. However, the products available on the website can only be purchased by CUSTOMERS requesting delivery within Italy.
Conclusion and effectiveness of the contract
The sale shall be considered concluded when Ardes srl sends an order confirmation e-mail to the CUSTOMER.
The e-mail shall contain the details of the CUSTOMER and the order, the price of the goods purchased, the transport costs and the shipping address to which the goods will be sent.
The CUSTOMER undertakes to verify the correctness of the data contained therein and to promptly notify Ardes srl of any corrections.
Products
The products that Ardes srl offers for sale are those described and displayed on the ardescosmetici.it website.
Ardes srl undertakes to describe and present the products sold on the website in the most accurate way possible. Nevertheless, there may be some errors, inaccuracies or small differences between the website and the actual product. Furthermore, the photographs of the products presented do not constitute a part of the contract, as they are purely representative.
The products for sale on the website and/or their characteristics are subject to change without notice.
The availability of the products refers to that present at the time the CUSTOMER consults the product sheets; this must, however, be considered purely indicative because, due to the presence of several users on the website simultaneously, the products could be sold to other CUSTOMERS before the order is confirmed.
Even after the order confirmation e-mail has been sent by Ardes srl, exceptional cases of partial or total unavailability of goods may occur.
In the event of an unfulfilled order due to unavailability, even temporary, of the product, Ardes srl shall notify the CUSTOMER in writing and shall immediately credit the CUSTOMER’s PayPal account with the amounts paid by the CUSTOMER.
Prices and Payment
Product prices are clearly indicated on the website, are in Euro and include the VAT applicable on the date the order is placed.
Before sending the purchase order, the CUSTOMER is advised to check the final sales price.
Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made.
The CUSTOMER accepts Ardes Srl’s right to amend its prices at any time.
The goods shall be invoiced on the basis of the prices indicated on the website at the time the order is placed and confirmed in the e-mail sent by Ardes srl as confirmation of purchase.
Payments can only be made by Credit Card, PayPal and bank transfer.
Once the CUSTOMER clicks to proceed to payment, depending on the method chosen, he/she will be immediately transferred to the protected systems of Monetaonline – SETEFI for Credit Card, PayPal (where he/she can access his/her account by entering his/her personal e-mail address and password) or he/she will be sent the data required for payment by bank transfer.
No payment data will pass through the Ardes srl servers.
Order entry and confirmation
To make a purchase, the CUSTOMER must choose the desired product click the “Add to Cart” button.
At any time, the CUSTOMER may view the products chosen and modify his or her order by clicking on the “shopping bag” button, located at the top right-hand corner of the webpage.
The CUSTOMER may instead click on the “Back to products” button to resume the selection and purchase of products.
To proceed with the order, the CUSTOMER must click on the “Proceed to Order” button. At this point, purchase information will be requested and the CUSTOMER may proceed with payment by choosing from the available methods.
Shipping and delivery
Orders will be prepared within 2 working days after the order is placed.
Should any unforeseen events occur during the processing of the order (delays, goods out of stock, etc.), the CUSTOMER shall be promptly informed by e-mail.
Ardes srl dispatches orders via express delivery, which usually guarantees arrival at their destination within 3-4 working days.
The CUSTOMER undertakes to promptly, and as soon as possible, check that the delivery includes all and only the products purchased and to promptly inform Ardes srl of any discrepancies with respect to the order placed, failing which the products shall be deemed accepted.
Should the package or wrapping arrive at the destination obviously damaged, the CUSTOMER may refuse delivery by the carrier/freight forwarder or accept delivery “conditionally”.
Right of Withdrawal
If, for any reason whatsoever, the CUSTOMER is not satisfied with the purchase made, he/she shall have 20 working days (10 more than the period provided by law) from the date of receipt of the goods to exercise his/her right of withdrawal and return the product, without any penalty in terms of the cost incurred for the product, therefore with the exception of the shipping and transaction costs incurred, which shall in any case remain entirely the CUSTOMER’s responsibility.
To return the goods, in their original packaging, the CUSTOMER must clearly indicate on the back of the transport document the reasons for the return, enclose it with the products to be returned, and send everything to: Ardes srl Via Fontanelle, 18 – 16012 Busalla (GE)
Ardes srl shall refund the value of the order, or part of it, if the withdrawal is partial, in the shortest time possible and in any case within 30 (thirty) days from the date on which it became aware that the CUSTOMER has exercised his/her right of withdrawal.
The refund shall be made by crediting the amount due back to the PayPal account used by the CUSTOMER for payment.
It is hereby understood that the risks and costs of transport relating to the return of the Products shall be borne by the CUSTOMER.
Intellectual Property Rights
All trademarks, names, as well as any distinctive sign, name, image, photograph, text written on the website or relating to the products are the exclusive property of Ardes Srl.
The contents of the website may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, or used for any purpose without the prior written consent of Ardes Srl.
Consumer data and protection of privacy
The CUSTOMER acknowledges that the personal data provided for the execution of the order will be recorded and used by Ardes srl, in accordance with and in compliance with the regulations set out in Italian Legislative Decree No. 196/2003 (the Privacy Code), as subsequently amended and supplemented, to execute each purchase.
